1. Agreement to These Terms
By accessing or using Qreat, you agree to these Terms. If you use Qreat on behalf of a restaurant, company, or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use Qreat.
2. Who We Are
Qreat is operated by [Legal Entity Name]. Contact details are listed at the end of these Terms.
Qreat provides software tools for restaurants, including QR ordering, menu management, live order management, table sessions, kitchen and printing workflows, order history, and operational analytics.
3. Business Use and Eligibility
Qreat is designed for restaurants, restaurant owners, managers, staff, and authorized business users. Qreat is not intended for children.
You are responsible for ensuring that all users invited to your restaurant workspace are authorized to act on behalf of the restaurant.
4. Qreat Manager and Restaurant Workspaces
Qreat Manager is a companion app for existing Qreat customers. To use Qreat Manager, you must have a Qreat account and access to an active restaurant workspace.
Workspace administrators are responsible for staff invitations, role assignment, permissions, workspace configuration, and removing access when staff members no longer require it.
5. Relationship to POS, Payments, and Guest Transactions
Qreat works alongside a restaurant’s existing POS and is not a POS replacement. Qreat does not guarantee compatibility with every POS workflow or hardware setup.
Qreat is not the seller of food, beverages, or other items offered by restaurants. The restaurant is responsible for its relationship with guests, including order fulfillment, pricing, taxes, refunds, receipts, allergy information, and customer service.
Qreat is not a payment processor. If payment or billing features are used, payment processing may be provided by a third-party provider such as Stripe under that provider’s terms.
6. Restaurant Responsibilities
Restaurants using Qreat are responsible for:
- Keeping menus, item descriptions, prices, availability, tax settings, and table information accurate.
- Reviewing and fulfilling orders submitted through QR ordering pages.
- Managing staff access, device access, and operational procedures.
- Complying with food safety, labeling, tax, consumer protection, privacy, employment, and other laws that apply to their operations.
- Handling guest requests, order corrections, cancellations, refunds, receipts, complaints, and disputes.
7. Accounts, Security, and Access
You are responsible for maintaining the confidentiality of login credentials and for all activity under your account or workspace.
You must promptly notify Qreat if you believe an account, device, staff role, or workspace has been compromised.
Qreat may suspend or restrict access if we reasonably believe there is unauthorized access, abuse, security risk, non-payment, or violation of these Terms.
8. Subscriptions, Fees, and Billing
Restaurants subscribe to Qreat separately through the website or another approved billing process. Plan features, prices, billing cycles, renewals, and cancellation terms may be presented during subscription signup or in a separate order, invoice, or agreement.
Unless otherwise stated, fees are non-refundable except where required by law or expressly agreed in writing.
Qreat Manager may be downloaded from the App Store, but access to Qreat Manager requires an active Qreat account and restaurant workspace.
10. Customer Content and Data
Restaurants retain ownership of their menus, restaurant data, order records, settings, and other content they submit to Qreat, subject to rights granted to Qreat to operate and support the service.
You grant Qreat permission to host, process, transmit, display, analyze, and back up customer content as needed to provide, secure, support, and improve Qreat.
Qreat’s handling of personal information is described in the Privacy Policy.
11. AI, Translation, and Analytics Features
Qreat may include AI, translation, analytics, or recommendation features. These outputs may be incomplete, inaccurate, delayed, or unsuitable for a particular operational decision.
Restaurants are responsible for reviewing translations, menu text, operational analysis, and any AI-assisted output before using it with staff or guests.
Qreat does not use customer content to train public AI models unless explicitly stated in a separate agreement.
12. Printing, Notifications, and Operational Workflows
Qreat may support kitchen display, printing, sound, notification, and order workflow features. These features depend on devices, browsers, networks, printers, settings, and third-party services.
Qreat does not guarantee that every order, alert, print job, or notification will be delivered without delay or failure. Restaurants should maintain operational procedures appropriate for their business.
13. Third-Party Services
Qreat may rely on third-party services such as cloud hosting, authentication, databases, storage, serverless functions, payment processing, error monitoring, AI, and translation providers.
Third-party services may be subject to their own terms and policies. Qreat is not responsible for third-party services beyond what is required by applicable law or separate written agreement.
14. Service Changes, Availability, and Beta Features
Qreat may modify, add, remove, suspend, or discontinue features from time to time. We aim to provide reliable service, but Qreat may be unavailable due to maintenance, incidents, third-party outages, network issues, or force majeure events.
Beta, experimental, or early access features may be changed or removed at any time and may not be as reliable as generally available features.
15. Termination
You may stop using Qreat or cancel a subscription according to the applicable billing or subscription terms.
Qreat may suspend or terminate access if you violate these Terms, fail to pay applicable fees, create security risk, misuse the service, or if continued access would create legal or operational risk.
After termination, access to the workspace and related data may be limited or removed, subject to retention obligations and backup practices.
16. Intellectual Property
Qreat, including its software, design, trademarks, logos, documentation, and related materials, is owned by Qreat or its licensors. These Terms do not transfer ownership of Qreat intellectual property to you.
You may use Qreat only as permitted by these Terms and any applicable subscription or agreement.
17. Disclaimers
Qreat is provided on an “as is” and “as available” basis to the extent permitted by law. Qreat does not warrant that the service will be uninterrupted, error-free, or compatible with every restaurant workflow, device, printer, network, or POS process.
Qreat does not provide legal, tax, food safety, accounting, or operational compliance advice. Restaurants are responsible for their own professional advice and compliance.
18. Limitation of Liability
To the maximum extent permitted by law, Qreat will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or guest disputes.
Where liability cannot be excluded, Qreat’s liability will be limited to the amount permitted by applicable law or any separate written agreement.
19. Apple App Store Terms
If you download Qreat Manager from the Apple App Store, Apple’s terms may also apply. Apple is not a party to these Terms and is not responsible for Qreat Manager, support, claims, or the operation of Qreat.
You must comply with applicable App Store rules, including any usage rules that apply to apps downloaded from the App Store.
20. Changes to These Terms
Qreat may update these Terms from time to time. When we make material changes, we will update the Effective Date and provide notice where appropriate. Continued use of Qreat after changes become effective means you accept the updated Terms.
